The Ontario Court of Appeal has held that claimants under the historic Indian Residential School Settlement Agreement have the right to control whether their stories will be archived. The Court held that documents created in the adjudication process were not subject to federal legislation as they were not in Canada’s control. Joseph J. Arvay Q.C. and Catherine Boies Parker of Farris, along with Susan E. Ross, acted for the successful Chief Adjudicator.
