Arden Beddoes Successfully Appeals Injunction at the BC Court of Appeal

On November 15, 2017, the British Columbia Court of Appeal released a judgment in favour of Farris’ client, a documentary filmmaker, who had an injunction granted against him by the Vancouver Aquarium. The Aquarium filed an action claiming copyright infringement and breach of contract relating to some of the footage. In April 2016, the Chambers Judge granted the interlocutory injunction, which required the filmmaker to remove 15 segments from the documentary. Leave to appeal of that decision was obtained in June 2016 and the appeal was heard on March 20, 2017.  Beddoes argued before the British Columbia Court of Appeal that the injunction was problematic because it attenuated the filmmaker’s right to free expression.  He was successful and the documentary can once again be shown in its original form.

The case has generated considerable public interest at all levels of court.
