Michelle is a litigator whose practice includes corporate, commercial, tax and estate litigation at trial and on appeal.  Michelle’s focus is on achieving results for her clients, whether through litigation or through negotiation, mediation or arbitration.

Michelle is an experienced trial lawyer who has appeared in the superior and appellate courts of British Columbia and Ontario, the Tax Court of Canada and the Federal Court of Appeal and she has acted in several reported cases.

Michelle’s corporate/commercial litigation practice involves a broad range of corporate commercial matters including, shareholder and partnership disputes (including oppression claims), commercial tenancy disputes, workplace disputes, breach of contract cases and tax litigation before the Tax Court of Canada, the Provincial Courts, and the Federal Court of Appeal.

Along with conventional pre-trial injunctions, Michelle has experience with asset freeze (“Mareva”) injunctions and civil search and seizure (“Anton Pillar”) orders.  Injunctions are often necessary to protect a client’s strategic position, its control over assets or property, or to protect intellectual property such as confidential information and trade secrets against theft and misuse by competitors and former employees.

Michelle has a significant practice involving the representation of plaintiffs, executors and beneficiaries, including not-for-profit and registered charitable organizations in estate and trust litigation.  Michelle has successfully represented her clients in a wide variety of cases including, wills variation cases, capacity matters, disputes between executors and beneficiaries and when required, the appointment of committees.

In addition to Michelle’s extensive litigation experience she spent several years as in-house Foreign Counsel to a Tokyo based public company where she was responsible for drafting and negotiating a wide variety of commercial agreements including joint venture, licensing, distribution and technology development agreements.
