Arden has a broad civil litigation practice and is experienced in complex commercial, constitutional and public law matters.

Arden has represented clients at all levels of court in British Columbia and Ontario, as well as at the Alberta Court of Queen’s Bench, the Federal Court of Canada, the British Columbia Securities Commission, and the Environmental Appeal Board. He has appeared as lead counsel in a wide range of court proceedings, including trials, appeals, applications for injunctive relief, and various other substantive and procedural hearings. Arden has also advised clients involved in private and court-monitored mediations and arbitrations.

In the commercial realm, Arden has litigated insolvency matters, shareholder disputes, copyright and intellectual property licensing disputes, securities disputes including contested takeovers and insider trading allegations, and disputes related to financing arrangements and real estate.

Arden is also involved in significant constitutional and public law litigation, including a constitutional challenge to the Canadian implementation of the United States Foreign Account Tax Compliance Act, representing an intervener in litigation regarding Trinity Western University’s application for accreditation from provincial law societies, and representing the proponent of a run-of-river hydropower project in multiple court proceedings.

Arden received his law degree from the University of Toronto and holds an honours degree in Economics and Political Science from Brown University. Before law school, Arden was an investment banker in New York.

He was called to the Ontario bar in 2012 and to the British Columbia bar in 2015. Prior to joining Farris, he clerked at the Ontario Superior Court of Justice, including on the Commercial List, and then practiced for over two years at a leading commercial litigation boutique in Toronto.
