Herb has practised in the fields of commercial transactions, corporate finance, securities and banking from 1976 to date. He has extensive experience in negotiating, drafting and interpreting a wide variety of documents, including credit and loan agreements, prospectuses and offering circulars, trust indentures for the issue of debt securities, agreements relating to the purchase and sale of businesses and other more specialized types of contracts.
Herb has broad experience representing lenders and borrowers in syndicated credit facility transactions, and in the issue of debt securities in the capital markets by way of prospectus offerings and through private placements. His experience in Public Private Partnerships includes acting for a short-listed proponent in the Lake Okanagan Crossing project; acting for the lender to a proponent in the Sea to Sky Highway project; participating as one of the Farris team representing (i) a short-listed proponent in the Southeast Stoney Trail project in Calgary Alberta, (ii) an unsuccessful bidder in the Surrey Memorial Hospital Redevelopment Project, and (iii) the successful proponent in the RCMP E Division Project (in each case primarily relating to financing matters); provided certain advice to the Province relating to its financial contributions to the Fort St. John Hospital Project and the BC Cancer Agency Centre for the North, and currently one of the Farris team acting for a proponent in the Surrey Pre-Trail Services Project.
Herb has been recognized by the 2012 Guide to the Leading 500 Lawyers in Canada, compiled by LEXPERT and American Lawyer, as one of thirteen leading corporate commercial lawyers in British Columbia. In the 2012 edition of the Canadian Legal Lexpert Directory, Herb is also listed as a leading Canadian lawyer in banking, corporate commercial, project finance and electricity law. He is listed in the banking section of the Chambers Global 2012 directory. He is also included in the banking law, corporate law, mergers & acquisitions law, project finance law and securities law sections of The Best Lawyers in Canada directory. Herb received a legal ability ranking of “AV Preeminent 5.0 out of 5” from Martindale-Hubbell, an authoritative and global source for identifying leading lawyers and law firms. He was appointed Queen’s Counsel in 2008.
