Professional liability and discipline issues are increasingly common and complex - and Farris lawyers know how to navigate them successfully.

Physicians, lawyers, accountants, directors and officers, financial advisors and investors, real estate agents, engineers, and other professionals may face allegations of negligence, breach of professional standards or, in extreme cases, criminal charges, which can lead to lawsuits, prosecutions or disciplinary hearings at a regulatory level. 

At Farris we understand the potentially devastating consequences of allegations made against a professional. Our lawyers have represented insurance professionals, accountants, lawyers, engineers, securities brokers, and firms in relation to professional liability claims and/or disciplinary proceedings. Some of our representative cases include:

  • Strother v. 3464920 Canada Inc., 2007 SCC 24, a landmark Supreme Court of Canada case where Farris lawyers successfully and significantly reduced a professional liability damages award for lawyer Robert Strother.
  • Retained to appeal the decision of Galambos v. Perez, 2008 BCCA 91 at the Supreme Court of Canada. Farris will represent the appellant lawyer concerning whether the lawyer owed and breached a fiduciary duty to his office manager.
  • Acted on behalf of insurance and reinsurance brokers in Swiss Reinsurance Company v. Camarin Limited, a case that involved novel issues concerning the duties owed by insurance brokers and reinsurance brokers to their insureds and reinsureds. The decision in this case has not yet been handed down.
  • Acted on behalf of insurance brokers in Bell Pole Company v. Commonwealth Insurance Company, 2003 BCCA 7. Farris successfully represented insurance brokers against allegations of negligence.
