Mediation & Collaborative Dispute Resolution

In addition to their work in litigation and arbitration, Farris lawyers have wide experience in resolving disputes through mediation and collaborative dispute resolution.

Mediation is a means of resolving disputes by agreement between the parties, with the assistance of a third party mediator.  Farris litigators have considerable experience in mediations in a variety of cases, including commercial disputes, family law matters, and personal injury claims.  They are experienced in advising clients on whether mediation is likely to be worthwhile in particular cases, and on the drafting of mediation agreements.  They regularly participate in mediations and engage in the attendant preparation, including preparing mediation briefs.  Farris litigators have also been successful in obtaining court orders compelling parties to mediate, leading to favourable settlements of complex litigation.

Further, in addition to other forms of dispute resolution, Farris’ family law group offers a collaborative law approach, a new process in family law dispute resolution that brings together family law lawyers and other professionals such as financial advisors and counsellors to help couples reach settlements without going to court.
